2. The Information Regulator’s guide
The Information Regulator publishes a guide, in every official language, on how to use PAIA and POPIA to get access to a record. You can read it at inforegulator.org.za or ask the Regulator for a copy at JD House, 27 Stiemens Street, Braamfontein, Johannesburg, 2001.
3. Records you can have without a request
Everything published on this website is available to anyone without a PAIA request, including our privacy policy, our terms of use, our prices and this manual.
4. Records we keep because the law requires them
- Companies Act 71 of 2008
- Tax Administration Act 28 of 2011 and Income Tax Act 58 of 1962
- Consumer Protection Act 68 of 2008
- Electronic Communications and Transactions Act 25 of 2002
- Protection of Personal Information Act 4 of 2013
- Promotion of Access to Information Act 2 of 2000
5. The records we hold
- Company records: registration documents, the share register, and directors’ decisions.
- Financial and tax records: accounts, bank records, tax returns, payment and refund records, and statements and payouts to partner studios.
- Member records: accounts, bookings, the credit ledger, memberships, payments, consents and support conversations.
- Studio partner records: applications, the terms each studio accepted, timetables, statements, payout and bank details, and correspondence.
- Supplier records: contracts and correspondence with the companies that run parts of hoppir for us.
- Website and app records: email sign-ups and the consent given with each, and technical logs.
6. How to ask for a record
Use Form 2 of the PAIA Regulations, which the Information Regulator publishes on its website, and send it to the Information Officer by email or to the address in section 1. Say which record you want, the form you want it in, and the right you want to exercise or protect with it, and include proof of who you are. If you are asking on behalf of someone else, include proof that you may.
We will decide within 30 days and tell you in writing. PAIA allows us to extend that once, by up to 30 days, and if we do we will tell you why.
7. Fees
Asking for your own personal information costs nothing. For any other record, the PAIA Regulations set a request fee (currently R140) and access fees for copies and for the time it takes to find and prepare a record. We will tell you what is due before we charge it.
8. When we may refuse, and what you can do
PAIA lets us refuse a record only on the grounds in Chapter 4 of its Part 3: for example, to protect another person’s privacy, a third party’s or our own commercial information, information given in confidence, someone’s safety, or legal privilege. If we refuse, we will give you the reasons. You may then complain to the Information Regulator, or apply to a court, within 180 days.
9. How we process personal information
Our privacy policy is the full account, and the parts this manual must cover are in it: why we process personal information (sections 2 and 3), whose information and what kinds (section 2), who receives it (section 4), what goes outside South Africa (section 5), and how we keep it secure (section 8).
10. Where to find this manual
This manual is published at hoppir.app/paia, and a copy is available at the address in section 1.
